Warranty terms.

WHO IS COVERED

This Limited Warranty is provided to YOU, the WARRANTY HOLDER listed above, and it cannot be transferred to any other person. Only YOU, and any person who is entitled under applicable state law, may enforce the obligations of this Limited Warranty. This Limited Warranty applies only to repair or replacement of ELIGIBLE TIRE(S) performed at the ISSUING LOCATION as defined under DEFINITIONS.

No other written or verbal representations have been made that in any way differ from what is outlined in this Limited Warranty. Payments will be made by US in accordance with the Limited Warranty guidelines contained herein. By signing, WARRANTY HOLDER agrees they have read and understand the terms, conditions and exclusions on the front and preceding pages of this Limited Warranty and understands and accepts them as outlined.

Any modification, alteration, or change to the preprinted terms and provisions of this Limited Warranty is invalid and of no force or effect. This Limited Warranty is only in force upon the receipt and acceptance of this Limited Warranty by the ADMINISTRATOR. The ISSUING DEALER will register this Limited Warranty, utilizing the provided online Limited Warranty registration form or other means as may be provided by the Administrator from time to time, within thirty (30) days of installation of the PUNCTURE PROTECTION PRODUCT into the YOUR tire(s).

THIS LIMITED WARRANTY IS NOT TRANSFERABLE, RENEWABLE OR CANCELABLE. THIS LIMITED WARRANTY IS NOT A SERVICE CONTRACT OR INSURANCE. IT IS A PRODUCT WARRANTY AND IS NOT SUBJECT TO INSURANCE LAWS BUT IS SUBJECT TO STATE LAWS CONCERNING WARRANTIES. IT IS PROVIDED TO THE CUSTOMER BY THE ISSUING LOCATION AT NO ADDITIONAL CHARGE. THE BENEFITS PROVIDED UNDER THIS LIMITED WARRANTY ARE ONLY REDEEMABLE AND SERVICEABLE AT THE ISSUING DEALER LISTED ABOVE. THE ADMINISTRATOR IS NOT OBLIGATED TO YOU UNDER THIS LIMITED WARRANTY. THIS LIMITED WARRANTY TERMINATES WHEN THE TERM LISTED ON THE SCHEDULE PAGE HAS BEEN REACHED OR WHEN OWNERSHIP HAS TRANSFERRED TO A NEW VEHICLE OWNER, OR IF THE MAINTENANCE REQUIREMENTS AS OUTLINED IN THIS LIMITED WARRANTY ARE NOT PERFORMED.

DEFINITIONS

This Limited Warranty contains several words that have special meanings. The following words are important in this Limited Warranty and they are printed in BOLD type below:

• ADMINISTRATOR – means SWG Administration, LLC 1603 Capital Avenue, Suite 507B, Cheyenne, WY 82001, 1-844-999-9981.
• EFFECTIVE DATE – means the date the PUNCTURE PROTECTION PRODUCT is installed on YOUR tires, as shown on the Schedule Page
• ELIGIBLE TIRE(S) – the tire(s) meeting the eligibility requirements described in this Limited Warranty.
• COVERED LOSS – the circumstances described under WHAT IS COVERED.
• COVERED VEHICLE – means the vehicle that YOU purchased from the ISSUING LOCATION that has 200,000 or less miles on the odometer at the time of vehicle purchase and that is of the current plus nineteen (19) previous model years.
• CUSTOMER, WARRANTY HOLDER, YOU, and YOUR – the customers(s) or any other or person who may be entitled to enforce this Limited Warranty that is designated as such on Schedule Page of this Limited Warranty.
• ISSUING DEALER, ISSUING LOCATION, WE, US, OUR – means the ISSUING LOCATION described as such on Page 1 of this Limited Warranty that is located in the continental United States or Canada.
• PUNCTURE PROTECTION PRODUCT – the puncture protection product professionally installed on the COVERED VEHICLE.
• TERM – the number of months or years specified on the Schedule.

TERMS AND CONDITIONS

Subject to the terms, conditions, limitations and exclusions stated in this PUNCTURE PROTECTION PRODUCT Limited Warranty PUNCTURE PROTECTION PRODUCT is designed with nano-polymer technology to seal tire punctures from nails or screws by surrounding the object and preventing air from escaping. When the object is removed from the tire, the sealant closes the hole within milliseconds, allowing YOU to continue YOUR journey safely. ELIGIBLE TIRES treated with the PUNCTURE PROTECTION PRODUCT can handle punctures up to ¼ inch (6mm) in diameter The PUNCTURE PROTECTION PRODUCT does not affect the TPMS, will not void the original tire warranty, enhance tire integrity and strengthens the casing, extends the life of the tire, and can be applied to new and used tires (tread life permitting). If the Administrator determines that a tire failure was attributed to the failure of the PUNCTURE PROTECTION PRODUCT, or the PUNCTURE PROTECTION PRODUCT'S failure to perform as specified, the ISSUING DEALER will repair the failed PUNCTURE PROTECTION PRODUCT, or replace the failed PUNCTURE PROTECTION PRODUCT with the same or equivalent PUNCTURE PROTECTION PRODUCT, or replace the ELIGIBLE TIRE at no charge to YOU. This Limited Warranty will apply to the original WARRANTY HOLDER of the PUNCTURE PROTECTION PRODUCT, as listed in Section 1 of the Schedule Page pursuant to the TERMS AND CONDITIONS set forth herein.

This Limited Warranty is provided by the ISSUING DEALER, as listed on the Schedule Page, at NO ADDITIONAL CHARGE to YOU, and is not cancellable. This Limited Warranty is not a service contract and is not insurance.

WHAT IS COVERED

During the TERM of this Limited Warranty, WE will cover the necessary costs to repair or replace an ELIGIBLE TIRE that experiences a COVERED LOSS, subject to the TERMS AND CONDITIONS, and EXCLUSIONS contained in this Limited Warranty.

An ELIGIBLE TIRE is a tire that:

• Has tread depth greater than the applicable minimum tread depth requirement of 2/32" for passenger vehicles;
• Is free from manufacturer, distributor, or installation defects, damage, or errors;
• Meets all other requirements of this Limited Warranty;
• Is not otherwise excluded from coverage under this Limited Warranty; and
• Holds compressed air without leakage or seepage to the tire manufacturer's recommended specifications under normal operating conditions.

A COVERED LOSS is a flat ELIGIBLE TIRE caused by and resulting from a road hazard object that punctures the repairable tread portion of the tire, causing an opening no greater than 1/4 inch in diameter, where the Tire Protectant fails to prevent the seepage or expulsion of air through the puncture opening, resulting in the tire becoming disabled from its intended use.

A COVERED LOSS does not include damage caused by tire porosity, bead leaks, or any other condition specifically excluded or limited under this Limited Warranty.

In the event of a COVERED LOSS, the ADMINISTRATOR will pay repair or replacement costs, subject to the limitations established in this Limited Warranty, prior to any repair or replacement, subject to the limitations herein. The ADMINISTRATOR retains the right to inspect the damaged tire, determine whether the claim qualifies as a COVERED LOSS, and determine the final amount payable under this Limited Warranty.

Upon the occurrence of a COVERED LOSS, YOU must follow the claim procedures outlined under HOW TO MAKE A CLAIM, including instructions for after-hours and emergency situations.

EXCLUSIONS

The ADMINISTRATOR and/or its affiliates shall not be liable for any claims or losses caused by, resulting from, or contributed to by any of the following, which are excluded under this Limited Warranty:

• No coverage will be provided if any repair(s) or replacement(s) are performed without receiving prior authorization from the Administrator;
• No coverage will be provided if the Covered Vehicle is sold to a second person or registered to any person other than the Customer named on the Schedule Page of this Limited Warranty;
• No coverage will be provided for any abuse, negligence, improper maintenance, or failure to maintain the Covered Vehicle or tires in accordance with the manufacturer's recommendations;
• No coverage will be provided for any tire that has been used and worn beyond its minimum legal limit of 2/32", or any other requirement established by a governing state, federal, or provincial authority, whichever is greater, or beyond the tire manufacturer's minimum specifications;
• No coverage will be provided for pre-existing tire damage, flaws, defects, or pre-existing punctures;
• No coverage will be provided for puncture damage to non-repairable areas of any tire, including the sidewall, shoulder, or any flex area outside of the tire's "crown";
• No coverage will be provided for tires containing puncturing objects prior to application of Tire Protectant;
• No coverage will be provided for tire failure resulting from tread separation, tire cuts, tire cracks, tire tears, or any damage, including punctures, to the sidewall;
• No coverage will be provided for punctures larger than 1/4 inch in diameter;
• No coverage will be provided for tire failure caused by tire materials or workmanship, faulty or damaged wheel rims, or faulty or damaged valve stems;
• No coverage will be provided for tires that are out of balance or have excessive wear due to failure to maintain proper tire inflation or balance;
• No coverage will be provided for seepage caused by wheel weights attached to the rim at the tire bead;
• No coverage will be provided for improper installation;
• No coverage will be provided for any modification or alteration made to the Covered Vehicle or tires that is not recommended by the manufacturer, or any damage resulting from such modification or alteration;
• No coverage will be provided for intentional damage, non-road hazard damage, vandalism, or malicious mischief caused by the Customer, vehicle users, or any third parties;
• No coverage will be provided for any loss or claim requiring replacement of the subject tire where the damaged tire is not made available for inspection by the Administrator and/or its authorized representative prior to and within thirty (30) days after the related claim submission;
• No coverage will be provided for any loss resulting from the use of the tire for unintended purposes, including but not limited to highway tires used off-road, or use of highway tires on any surface other than a publicly maintained highway, road, or street;
• No coverage will be provided for any vehicle used for commercial purposes, including but not limited to taxi, public hire, rideshare, livery, rental, limousine, towing, delivery service, construction, farming, ranching, hauling, emergency services, or any vehicle with non-standard equipment installed specifically to facilitate commercial use;
• No coverage will be provided for damage to a tire that is not an Eligible Tire;
• No coverage will be provided for labor costs associated with removal or installation, unless specifically stated in this Limited Warranty;
• No coverage will be provided for cosmetic damage;
• No coverage will be provided for damage caused by collisions, debris impacts, or environmental conditions that damage the structural integrity of the tire, except as specifically covered under this Limited Warranty;
• No coverage will be provided for any loss, repair, replacement, or service covered by insurance, manufacturer warranty, recall, factory service bulletin, or any other special policy;
• No coverage will be provided for repairs or replacements performed outside of the United States or Canada;
• No coverage will be provided for any vehicle not originally manufactured to meet U.S. specifications, commonly known as grey market vehicles, salvaged vehicles, or factory buybacks;
• No coverage will be provided for storage charges, shop supplies, materials charges, diagnostic procedures, or other fees not specifically covered under this Limited Warranty;
• No coverage will be provided for fraudulent acts, statements, or misrepresentations made by the Customer or Issuing Dealer in connection with a claim or request for service;
• No coverage will be provided for any damage or loss occurring prior to the Warranty Effective Date listed on the Schedule Page of this Limited Warranty; and
• No coverage will be provided for any other loss, damage, or liability other than that specifically set forth in this Limited Warranty.

HOW TO MAKE A CLAIM

To obtain benefits under this Limited Warranty, YOU must comply with the following conditions: (1) ALL CLAIMS MUST BE CALLED IN FOR AUTHORIZATION PRIOR TO REPLACEMENT; (2) All claims must be reported as soon as reasonably possible to the ADMINISTRATOR, SWG Administration, LLC 1603 Capital Avenue, Suite 507B, Cheyenne, WY 82001, 1-844-999-9981, Monday through Friday from 9 a.m. to 5 p.m. Eastern Time; (3) YOU must return to the ISSUING DEALER to have repairs and replacements done; (4) All non-working parts must be made available to the ADMINISTRATOR for inspection; (5) The ISSUING DEALER must forward a copy of the original repair order to the ADMINISTRATOR for final payments; (6) The ISSUING DEALER will be paid once an appropriate repair order with YOUR signature is received by the ADMINISTRATOR. (7) The ADMINISTRATOR is solely responsible for administering claims and authorizing payment for COVERED LOSSES under the terms, conditions, limitations, and exclusions set forth in this Limited Warranty. The ADMINISTRATOR does not provide tires or repair services directly.

EMERGENCY CLAIM PROCEDURES

In the event that the COVERED LOSS occurs after the ADMINISTRATOR'S regular business hours, or on a weekend, and replacement must be affected, YOU MUST follow these instructions: Call the ADMINISTRATOR on the following business day: SWG Administration, LLC 1603 Capital Avenue, Suite 507B, Cheyenne, WY 82001, 1-844-999-9981 Monday through Friday from 9 a.m. to 5 p.m. Eastern Time; All after-hours instructions must be followed to receive reimbursement. YOU must reasonably believe that the failed part is a COVERED LOSS by this Limited Warranty. Upon notice to the ADMINISTRATOR, the ADMINISTRATOR will determine if the repair and or replacement is a COVERED LOSS by this Limited Warranty. YOU MUST provide the following: (a) the original, paid, repair invoice with YOUR signature; (b) legible copies of the front and back of this Limited Warranty; (c) a legible copy of YOUR vehicle purchase order and finance agreement, if requested; and (d) photos of the damaged tire. NOTE: THE ADMINISTRATOR RESERVES THE RIGHT TO INSPECT ANY DAMAGED TIRE PRIOR TO DISPOSAL. FAILURE TO PRESERVE DAMAGED PROPERTY MAY RESULT IN CLAIM DENIAL.

ADDITIONAL LIMITATIONS AND EXCLUSIONS

ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF TIME AS THE WRITTEN LIMITED WARRANTY STATED HEREIN. YOU ARE NOT ENTITLED TO RECOVER FROM THE ISSUING DEALER ANY CONSEQUENTIAL DAMAGES, DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF USE, LOSS OF TIME, LOSS OF PROFITS, OR INCOME, OR ANY OTHER INCIDENTAL DAMAGES.

LEGAL RIGHTS NOTICE: THIS LIMITED WARRANTY SETS OUT THE FULL EXTENT OF OUR RESPONSIBILITIES, AND THE EXCLUSIVE REMEDY REGARDING THE REPLACEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN ADDITION, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

WE EXPRESSLY DISCLAIM ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE UNDER THIS AGREEMENT.

This Limited Warranty contains the entire agreement between the parties relating hereto and supersedes all prior written and oral agreements between the parties regarding the contents herein. No provision of this Limited Warranty may be amended or otherwise modified except by a writing signed by the parties to this Limited Warranty. If a court or other body of competent jurisdiction finds any provision of this Limited Warranty, or portion thereof, to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Limited Warranty will continue in full force and effect. No provision of this Limited Warranty may be waived except by a writing executed by the party against whom the waiver is to be effective. A party's failure to enforce any provision of this Limited Warranty shall neither be construed as a waiver of the provision nor prevent the party from enforcing any other provision of this Limited Warranty.

STATE DISCLOSURE

Georgia: This Limited Warranty is a product warranty and is not insurance. In Georgia, WE, OUR, and ADMINISTRATOR mean SWG Administration, LLC 1603 Capital Avenue, Suite 507B, Cheyenne, WY 82001, 1-844-999-9981. This Limited Warranty is not cancellable by YOU or SWG Administration, LLC. This Limited Warranty is insured for its liability under a Reimbursement Insurance Policy issued by Old Republic Insurance Company (Tulsa Branch Office), 8282 South Memorial Drive, Tulsa, OK 74133. All claims should be filed with US at 1603 Capital Avenue, Suite 507B, Cheyenne, WY 82001. If a covered service is not provided by US before the sixty first (61st) day of filing proof of loss, YOU may apply for reimbursement directly to Old Republic Insurance Company (Tulsa Branch Office), 8282 South Memorial Drive, Tulsa, OK 74133.
